A young M.Tech graduate working as a Fellow-A at IIT Roorkee died in a motor accident. His parents claimed compensation. The Supreme Court upheld the High Court's decision to include his Rs.12,000 monthly fellowship (in addition to salary) when computing loss of dependency, as the entire compensation package must be considered. However, the Court modified the deduction for personal expenses from 33% to 50%, as the deceased was an unmarried bachelor who would likely have married and supported children. The final award was Rs.26,75,000 with 9% interest from the claim filing date.
