In Brief

The National Medical Commission challenged a High Court order directing creation of an additional seat for a medical college admission. The Supreme Court held that while directions to increase intake capacity are impermissible, the respondent college had unfairly denied the student postgraduate admission. Though the admission denial could not be remedied by creating a new seat, the student was entitled to compensation for the lost academic year and guaranteed admission to the MS (General Surgery) course in the next year from the Management Quota. The appeal was disposed of with these directions.
