A motor vehicle registered in one person's name was transferred to another, but the change was not registered. When an accident occurred, the original registered owner was held liable by the Tribunal for compensation. The High Court reversed this, holding only the transferee liable. The Supreme Court allowed the original appeal, holding that the registered owner remains liable under the Motor Vehicles Act, Section 2(30), unless the vehicle is subject to hire-purchase, lease, or hypothecation agreements. This protects accident victims from uncertainty and the burden of tracking successive unregistered transfers.
