A real estate developer failed to deliver possession of a residential unit within 2.5 years as promised. The buyer sought compensation and interest for the delay. The Supreme Court held that the developer's force majeure claim (contractor disputes and boundary wall issues) was unjustified. Although the contract limited compensation to Rs 2 per sq ft, the Court found this one-sided clause unfair and unenforceable. The buyer was awarded interest at 7% per annum from 1 January 2016 until possession was delivered, but the Court rejected additional compensation for loss of rent to avoid double recovery. The appeal was partly allowed with modified interest terms.
