Neha @ Pooja Alizad vs Vaibhav Kumar @ Chetan Sancheti

Bench: 1 — <UNKNOWN>

In Brief

This case concerns a Transfer Petition where both parties sought a mutual divorce under Section 13B of the Hindu Marriage Act, 1955, relying on Article 142 of the Constitution. The petitioner and respondent had complied with all settlement terms agreed before a mediator. The single-Judge Court held that it lacks jurisdiction to grant such a decree under the Supreme Court Rules, 2013. A single Judge can only grant relief under Section 25 of the Civil Procedure Code. Accordingly, the matter was referred to the Chief Justice for necessary directions and authorization before any divorce decree could be granted."
