A wife appealed the dissolution of her marriage on grounds of cruelty and desertion, filed by her husband, an Army officer. The family court and high court had upheld the divorce decree. The Supreme Court confirmed the divorce, finding irretrievable breakdown of the 16-year marriage since the parties had been separated since 2011 and the husband had remarried. However, the court directed the husband to pay Rs. 50,000 per month to maintain their minor son, with arrears of approximately Rs. 1.2 crore to be recovered through his Army salary, not exceeding 50% monthly deduction.
