Neil Aurelio Nunes & Ors vs Union of India & Ors

Bench: 2 — Dhananjaya Y. Chandrachud

In Brief

Doctors who appeared in NEET-PG 2021 challenged a notice implementing 27% OBC and 10% EWS reservations in All India Quota seats. They also contested the EWS income criteria (Rs 8 lakhs) as unconstitutional. The Supreme Court issued an interim order allowing counselling to proceed with these reservations using the existing EWS criteria for 2021-2022. The OBC reservation was upheld. However, the validity of the EWS criteria remains prospectively subject to the final hearing on merits, scheduled for March 2022. Detailed reasons were reserved.
