Nimay Sah vs State of Jharkhand

Bench: 2 — N.V. Ramana

In Brief

Nimay Sah, elder brother of the deceased's husband, was convicted under Section 498-A IPC (cruelty for dowry) by the trial court and the High Court upheld the conviction. The Supreme Court examined the evidence afresh and found that witness testimonies naming the appellant were vague, did not specify instances of harassment, and independent witnesses did not support the prosecution case. Letters from the deceased to her brother contained no mention of dowry-related harassment. The Court held that the ingredients of Section 498-A IPC were not proved beyond reasonable doubt and set aside the High Court's judgment, acquitting the appellant.
