The Supreme Court upheld the rights of AYUSH doctors (practising Ayurveda, Unani, and other traditional Indian systems) employed by Delhi municipal corporations to equal superannuation age (65 years) as allopathic doctors, effective from 31 May 2016. The Court held that classifying doctors differently based solely on medical system constitutes unlawful discrimination under Article 14. Doctors who worked beyond age 60 on strength of interim court orders are entitled to full unpaid salary and arrears. Financial burden on the State cannot justify denial of lawful remuneration. The Court ordered payment within 8 weeks with 6% interest on late payment.
