NUR AHAMAD ABDULSAB KANAVI vs ABDUL MUNAF & ORS

Bench: 2 — Sanjay Karol, Prashant Kumar Mishra

In Brief

A motorcyclist aged 27 was struck by a goods vehicle in June 2014 and suffered severe injuries requiring two months of hospitalization. He claimed Rs 30 lakh compensation under the Motor Vehicle Act, stating he earned Rs 10,000 monthly and was now 100% disabled. The MACT awarded Rs 6.78 lakh (at Rs 7,500 monthly income and 20% disability). The High Court enhanced this to Rs 25.69 lakh with 100% disability but retained the lower income figure. The Supreme Court allowed the appeal, accepting the claimant's oral evidence of Rs 10,000 monthly income and awarding Rs 37.51 lakh total compensation, including enhanced amounts for pain and suffering, attendant charges, and loss of amenities.
