OACHIRA PARABRAHMA TEMPLE & ANR vs G. VIJAYANATHAKURUP AND ORS

Bench: 3 — Sanjiv Khanna, Sanjay Kumar, R. Mahadevan

In Brief

The Oachira Parabrahma Temple, a unique ancient structure without a consecrated idol, manages a superspecialty hospital, nursing college, and school. Elected officials challenged orders removing their committee and appointing unelected replacements. The Supreme Court held that a High Court becomes functus officio after disposing an appeal and cannot entertain fresh applications modifying its orders. The Court appointed a retired judge as Administrator to conduct fresh elections per the temple bye-laws within four months, modified the High Court's orders, and directed the trial Court to complete Scheme framing proceedings expeditiously.
