Om Prakash appealed a High Court eviction decree against Suresh Kumar. The Supreme Court noted that while the appellant's initial counsel did not exceed his authority, the appellant improperly engaged a different advocate to file a review petition. Deprecating this conduct, the Court modified the eviction decree in the interest of complete justice. Instead of full eviction, the Court ordered partition of the ground floor premises by a brick wall beyond 7.57 meters, requiring the appellant to re-induct the respondent in the front portion while retaining the rear for staircase access. This modification balanced the respondent's restitution rights against the appellant's substantial damages liability. The appeals were partly allowed with no order as to costs.
