ONGC Purbanchal Employees Association vs Union of India & Ors

Two unions representing contract workers at ONGC Ltd. challenged a High Court Division Bench decision that had remitted an industrial dispute back to the Industrial Tribunal. The workers sought regularization as permanent employees or equal pay and benefits. The Supreme Court held that since the Single Judge had already meticulously examined all relevant aspects of the Industrial Tribunal's award, the Division Bench should have decided the appeal on merits rather than remitting it. The Court set aside the remittal and sent the matter back to the High Court, directing the Division Bench to dispose of the appeals on merits within six months.
