Orange Business Services contracted with JAP-IT (Jharkhand Agency for Promotion for Information Technology) to design and set up a state data centre. A dispute arose over payment of approximately Rs. 2.09 crore, which the respondent deducted citing implementation delays allegedly caused by the applicant. The applicant blamed the respondent for failing to provide the site and raw power supply on time. Two arbitrators appointed by the parties under the contract could not resolve the dispute. The Supreme Court appointed Hon'ble Justice (Retd.) Jaya Roy as sole arbitrator to resolve the dispute, directing the proceedings to be concluded within six months.
