He was later acquitted by the High Court, and his employer reinstated him but refused back wages for the suspension period (21.07.1994 to 31.08.1999). The Supreme Court dismissed his appeal for back wages, holding that reinstatement does not automatically entitle an employee to back pay unless expressly awarded. The Court noted the employee must prove he was not gainfully employed during the suspension period, and found no such evidence was presented in the writ petition proceedings.
