A father of a murder victim filed an appeal before the Supreme Court seeking enhancement of the convicted murderer's life sentence to death penalty. The High Court had dismissed the appeal as not maintainable. The Supreme Court held that under Section 372 of the Criminal Procedure Code, a victim's right to appeal is limited by statute to three grounds: acquittal, conviction for a lesser offence, or inadequate compensation. Enhancement of sentence is not included. While the State Government can appeal for inadequate sentences under Section 377, victims have no such right. The appeal was dismissed.
