Pintu Ghosh vs State of Assam and Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Pintu Ghosh appealed against a Gauhati High Court order requiring deposit of Rs. 14,05,000/- raised from the public auction of bricks. The appellant sought permission to withdraw the deposited amount. The Supreme Court held that while the deposit order was justified, the appellant could pursue release through a representation to the Deputy Commissioner within eight weeks. The Deputy Commissioner was permitted to deduct any amounts legitimately due to other respondents before releasing the balance to the appellant. The appeal was disposed of without costs.
