Placido Francisco Pinto (D) by Lrs & Anr vs Jose Francisco Pinto & Anr

Bench: 2 — Hemant Gupta

In Brief

An elder brother purchased his younger brother's share of ancestral property by paying off the latter's debts and executing a registered sale deed. The younger brother later claimed the deed was obtained by fraud through misrepresentation, arguing he did not understand the document's contents. The Supreme Court held that a registered sale deed carries a presumption of legality and cannot be vitiated by mere feigned ignorance. Since the respondent admitted receiving the debt payment and signing the deed, and since no actual plea or proof of fraud was established, the sale deed remained valid. The Court upheld the trial court's decree for possession and accounts, dismissing claims based on unsubstantiated fraud allegations."
