Power Machines India Ltd. challenged Rule 5 of the Madhya Pradesh Micro and Small Enterprises Facilitation Council Rules, 2006, which permitted recovery of arbitral awards as arrears of land revenue. The appellant argued Rule 5 was unconstitutional and harsher than the Code of Civil Procedure's execution procedure. The Supreme Court upheld Rule 5, holding that State Governments can enact alternative and expedited remedies through subordinate legislation. The Court reasoned that plural inconsistent remedies are valid in law; the aggrieved party may elect which to pursue. Rule 5 remains ancillary to the parent Act's purpose of protecting micro, small and medium enterprises and does not deprive debtors of fair treatment. The judgment was dismissed with costs.
