In Brief
The Supreme Court allowed a criminal appeal by quashing the High Court's order that had cancelled a summoning order against five accused persons. The accused were charged with cheating, forgery, and criminal conspiracy in relation to a disputed land sale. The High Court had held that since the accused (a bhumidhar landowner) had transferable rights, the matter was purely civil in nature. The Supreme Court held that at the summoning stage, a magistrate need only determine if there is sufficient ground to proceed—not evaluate the evidence fully or determine guilt. The High Court erred in entering findings on the merits. The case was remitted to the trial court.
