In this transfer petition, a respondent sought permission to withdraw a Hindu Marriage Petition (filed in the Family Court) while a transfer petition was pending before the Supreme Court. The respondent's counsel argued that owing to the stay granted by the Supreme Court, he could not approach the Family Court for withdrawal. The Court permitted the withdrawal by recording the respondent's statement of intent, disposing of the transfer petition conditionally. The petitioner was granted the right to revive the transfer petition if the respondent later prosecutes the marriage petition without withdrawal or if the Family Court rejects the withdrawal application."
