In this appeal, the Court examined whether the State of Orissa had properly implemented constitutional provisions allowing promotion with consequential seniority for Scheduled Castes and Scheduled Tribes in Class-I Services. The Court found that the State had issued only executive orders based on Government of India instructions without examining whether representation of SCs and STs in such positions was adequate, as required by Article 16(4A) of the Constitution (as amended). Since the State failed this mandatory examination, the appeal was dismissed.
