The Court held that she cannot simultaneously retain possession and benefit from the extraordinary compensation. The principle of equity prevents such unjust enrichment. Section 53-A of the Transfer of Property Act does not apply. The Court upheld execution with police assistance and dismissed the appeal with costs of Rs. 10 lakhs.
