The Court held that where a decree for specific performance of a property sale requires the buyer to deposit the balance consideration within a specified period, failure to make such deposit without obtaining an extension of time from the court renders the decree unexecutable. The mere fact that the seller did not seek rescission of the contract under the Specific Relief Act does not automatically extend the period or permit execution. The Court allowed the appeals, set aside the High Court's reversal, and restored the Executing Court's order rejecting execution. The decree-holders were entitled only to withdraw their deposited amount.
