Premlata Acharya vs Suman Acharya and ors

Bench: 2 — Madan B. Lokur

In Brief

A widow obtained compassionate appointment following her husband's death but later remarried and left her five children under her father's care. The High Court directed that her family pension be paid to her father for the children's benefit, along with 50% of her salary. The Supreme Court upheld this approach, holding that although the compassionate appointment could have been terminated for breach of the maintenance condition, directing 50% salary and family pension to the grandfather was an appropriate remedy. The payments should continue until the youngest child reaches 25 years, the age at which family pension ceases under applicable rules.
