Flat purchasers sought extension of interest compensation for delayed possession beyond 31 July 2016. The National Consumer Disputes Redressal Commission had awarded 6% annual interest only until that date, despite possession not being handed over. The Supreme Court held that liability for interest continues until each purchaser is actually offered possession, not an arbitrary cutoff date. The Court rejected the developer's argument that contractual compensation terms were binding, finding them inadequate. The Court also noted the developer had admittedly withheld possession from 43 purchasers solely because they filed consumer complaints. The appeal was allowed and interest liability was extended until actual possession delivery."
