Rabari Prabhatbhai Gugubhai & Ors vs State of Gujarat & Ors

Bench: 3 — Kurian

In Brief

Five candidates selected under the General category and one under the Socially and Economically Backward Category (SEBC) for driver positions in Gujarat's subordinate courts could not be appointed because the High Court only considered their first district choice. The Supreme Court held that where multiple options are permitted, subsequent options must be considered if the first is unavailable. The Court directed that the appellants be appointed in their respective categories from 24 available vacancies, and required the High Court to issue a corrigendum within two weeks reflecting the reduction in vacant positions.
