An Army officer with nine years' service was charged under Section 41(2) of the Army Act for disobeying lawful commands from his superior officer on two occasions—failing to report for duties at his Radio Monitoring Detachment unit. He was terminated following a Summary Court Martial. When he challenged this before the Armed Forces Tribunal, the Supreme Court upheld the dismissal. The Court held that deliberate disobedience of lawful commands is a serious military offence, especially after substantial service. The officer's refusal to sign documents, cross-examine witnesses, or present a defence further compounded the gravity. Termination was proportionate punishment for such conduct in the armed forces context.
