Ragini Dwivedi, an actress, was arrested following a complaint alleging involvement in a drug trafficking network. No drugs were found in her residence, but she was charged under the NDPS Act based on a witness statement. Both the trial court and High Court denied bail citing Section 37 of the NDPS Act. The Supreme Court held that Section 37 was wrongly applied because the drug seizures cited were aggregated from multiple accused persons, not from the appellant alone. With no chargesheet filed and the case resting solely on hearsay evidence, the Court granted bail, setting aside the High Court's order."
