Raj Kumar @ Raju vs State (NCT of Delhi)

Bench: 2 — Ranjan Gogoi

In Brief

The appellant was convicted of murder and robbery by the trial court. On appeal, the Supreme Court partly allowed the appeal. While the conviction under the murder statute (Section 302 IPC) was set aside and the appellant acquitted, the conviction under the dacoity/robbery statute (Section 392 IPC) was upheld. The Court found that recovery of deceased's ornaments from the appellant, though suspicious, did not conclusively prove murder without evidence showing the robbery and murder were part of the same transaction. The significant time gap between the accused's last sighting and crime discovery created reasonable doubt. The appellant was ordered released as the robbery sentence had already been served."
