The Supreme Court dismissed a civil appeal challenging a High Court decision that upheld a sale deed. The appellants claimed their deceased father had been induced to execute the deed through fraud and undue influence due to his old age and infirmity. The Court held that merely proving the grantor's age, infirmity, and living situation with the defendants is insufficient to presume mental incapacity without affirmative evidence. Old age alone does not warrant presumption of senility or dementia. Finding no exceptional grounds to interfere with concurrent findings of both the trial and High Courts, the appeal was dismissed without costs.
