Landowners whose garden lands were acquired for an IT Park in Kerala contested the High Court's compensation award of Rs. 1,35,000 per cent (a 35% increase on the negotiated price of Rs. 1,00,000). The Supreme Court held that while the negotiated price paid to other landowners was a relevant reference point, the 35% enhancement was insufficient. Considering the lands' prime location, road access, and proximity to the IT Park, the Court modified the award to Rs. 1,60,000 per cent (a 60% increase), holding this constituted just and fair compensation. The acquiring authority was directed to deposit the enhanced amount within six weeks.
