A Rajasthan Housing Board employee challenged his dismissal and subsequent removal orders through a writ petition. The High Court's Single Judge quashed the dismissal order and allowed the employee to adduce evidence. The Division Bench upheld this decision but directed that departmental proceedings continue before a labour court. The Supreme Court held that once a dismissal order is validly quashed in a writ petition, departmental proceedings cannot continue based on that order. The Court allowed the appeal, ruling that the writ petition should be decided afresh by the Single Judge without direction to continue proceedings that were the subject of the challenge.
