The Supreme Court clarified that wait-listed candidates have no automatic right to appointment. In these three recruitment cases, candidates on the Rajasthan Public Service Commission's reserve lists sought appointment when selected candidates didn't join. The Court held that a reserve list operates only for six months from when the original list is sent to the employer, and only when vacancies arise during that period. Once the reserve list expires, candidates cannot claim appointment rights. The Court also confirmed that the PSC itself has standing to challenge court orders that compel it to act beyond statutory limits. Wait-listed candidates can only claim appointment if governing rules permit it within the validity period and the employer acts arbitrarily—not otherwise.
