The Rajasthan State Road Transport Corporation refused to grant pension to an employee on the ground that he had already received pension under a CPF (Contributory Provident Fund) Scheme. The Supreme Court held that an employer cannot deny statutory pension merely because the employee received benefits under another scheme. The Court directed the Corporation to grant pension without deducting the CPF pension already received. However, to balance equities, the respondent was required to refund any excess gratuity within two months, with pension payment commencing only thereafter. The appeal was dismissed with these modifications."
