A road transport conductor compulsorily retired in 2003 sued in 2010 for Selection Grade pay benefits available to employees with satisfactory service records after 9, 18, and 27 years of service. The trial court and first appellate court partially granted relief. The Supreme Court held the suit barred by limitation (seven years exceeded the three-year period under Article 137) and, on merits, that the respondent's record of 19 disciplinary charge-sheets disqualified him from the benefit, which requires a clean service record. The appeal was allowed and the suit dismissed.
