A Wakf Board appealed against a High Court decision that quashed a Wakf Tribunal's decree in a dispute over land adjacent to a mosque. The respondents had sold the disputed land without the Board's permission, and the Tribunal found it to be Wakf property and declared the sale void. The High Court held the Tribunal lacked jurisdiction and that the matter should be tried in Civil Court. The Supreme Court allowed the appeal, holding that under the Waqf Act, 1995, the Tribunal has exclusive jurisdiction to determine whether property is Wakf property and to decide matters relating to unlawful alienation of Wakf land. Civil Courts have no jurisdiction over such disputes. The matter was remitted to the High Court to decide the revision on merits.
