Rajesh Mohanlal Solanki vs State of Maharashtra

Bench: 2 — S.A. Bobde

In Brief

In this criminal appeal, the appellant was convicted under Section 302 read with Section 149 IPC for the death of Ramdas during an incident involving seven accused. The only overt act attributed to the appellant was holding a sword, from which injuries were sustained by another person attempting to snatch it. No injury directly caused by the appellant was established to have resulted in the victim's death. The Court found that since other co-accused with similar involvement had been acquitted of the same charge, and the appellant's specific overt act causing death was not established, the conviction could not be sustained. The appeal was accordingly allowed and the appellant acquitted."
