An accused filed a special leave petition challenging a High Court order relating to supply of a copy of a judgment. The Supreme Court held that Section 353(6) of the Code of Criminal Procedure requires an accused to be personally present in Court on the date of judgment, unless prior dispensation has been granted. Section 363(1) granting a convicted accused a free copy of the judgment must be read harmoniously with this requirement. Since the petitioner failed to appear on the judgment date, he could not claim the judgment copy as of right. The petition was dismissed."
