A mother sought a writ of Habeas Corpus to recover her two minor children (ages 12 and 8) whom their father had unilaterally removed from the USA to India in breach of a shared parenting plan and US court orders. The children were US/permanent residents, educated and settled in Ohio. The father claimed the children were happily living with grandparents in Chennai and that the mother suffered from mental illness. The Supreme Court held that child welfare is the paramount consideration overriding all other factors, including comity of courts and foreign court orders. Since both children were accustomed to American life, education, and culture, and the mother was established in the USA with resources and stability, the Court ordered the father to take the children back to the USA within prescribed timeframes, or alternatively allow the mother to retrieve them if visa was denied.
