Rajinder vs State of Haryana

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Rajinder was convicted by the courts below of murdering one Dharambir based on an extra-judicial confession, allegedly inserting a screwdriver into the victim's neck. However, the Supreme Court found that the co-accused who inflicted the fatal blow to the head was acquitted. In this circumstantial evidence case involving death after alcohol consumption and altercation, the Court reduced the conviction from Section 302 IPC (murder) to Section 304 Part II IPC (culpable homicide not amounting to murder) and reduced the sentence to the time already undergone (approximately six years eight months). The appeal was allowed.
