RAJNISH KUMAR RAI vs UNION OF INDIA & ORS

Bench: 2 — Aniruddha Bose, Bela M. Trivedi

In Brief

The petitioner, Rajnish Kumar Rai, filed a Special Leave Petition challenging the High Court of Gujarat's dismissal of his writ petition. The writ petition sought to challenge the Central Administrative Tribunal's Principal Bench rejection of his application to transfer his case from Hyderabad to Ahmedabad. The Supreme Court held that the High Court of Gujarat lacked territorial jurisdiction to entertain the writ petition because the transfer order was passed by the CAT Principal Bench at Delhi, which falls outside Gujarat's territorial jurisdiction. Additionally, the Court found no merit in the transfer plea on grounds of inconvenience alone, given that the case had reached its final hearing stage. The petition was dismissed.
