Rakesh & Anr vs State of Haryana

Bench: 2 — Banumathi

In Brief

In this criminal appeal, two brothers (Rakesh and Dalbir) were convicted of attempted murder under Section 307 IPC read with Section 34, and for offences under Sections 324, 325, and in one appellant's case, Section 25 of the Arms Act. The victim, Raj Kishan, was attacked with a blunt weapon and shot on the neck. Medical evidence confirmed the gunshot wound was dangerous to life. The Supreme Court upheld the conviction for attempted murder but reduced the sentence from seven to five years, considering the appellants' youth at the time of the 2000 offence and the passage of time.
