In Brief
This case concerns the partition of joint family property and the determination of respective shares following multiple deaths. Fuchan Mahto (died 1940) left a widow Puniya Devi and son Mithu Sao. After Mithu Sao's death in 1961, a notional partition under the Hindu Succession Act, 1956, recognized eight sharers including his widow and mother. The Supreme Court held that the appellants (children of Mithu Sao's first wife) were entitled to 38.1% of the joint family property, not the 37.5% awarded by the lower courts, based on principles of Hindu succession law and women's inheritance rights."
