Ramesh Kumar Alias Babla vs State of Punjab

Bench: 2 — Shiva Kirti Singh

In Brief

The appellant was convicted under Section 307 IPC (attempt to cause death) for attacking the complainant with a sword during a group clash, but appealed contending he should have been convicted under Section 324 IPC (voluntarily causing hurt by dangerous weapon). The Supreme Court allowed the appeal in part, converting the conviction from Section 307 to Section 324, as the evidence showed only a single simple sword injury attributable to the appellant. The Court also granted benefit of the Probation of Offenders Act, directing release on bond with one year's imprisonment suspended, considering the 19-year delay and the appellant's rehabilitation since the 1997 incident."
