Ramo Bai & Ors vs State of Haryana & Ors

Bench: 2 — Kurian

In Brief

The appellants challenged awards of land acquisition compensation set at Rs. 235 per Sq.Yd., seeking enhancement to Rs. 325 per Sq.Yd. as granted to similarly situated owners under the same notification (per Ashrafi v. State of Haryana). The Court found the appellants' lands were identically situated and granted the enhanced rate on merits. However, as a consequence of delays in filing and refiling special leave petitions, the Court excluded statutory benefits for those delay periods while awarding the principal land value at Rs. 325 per Sq.Yd. The appeals were partly allowed.
