Ramprakash Gupta vs State of Madhya Pradesh and Ors

Bench: 2 — 2

In Brief

A kerosene dealer's licence was cancelled by the Collector for violating distribution regulations. The appellant claimed the Minister had allowed his revision petition on 26.08.2003 but passed another dismissal order on 17.01.2005. The High Court examined the record and found the 26.08.2003 order contained serious interpolations: key phrases were scored out and altered, the document lacked a case number and date of issuance, and was never processed by the Department. The Supreme Court upheld the High Court's finding that this alleged order was not a valid order in law, affirming dismissal of the appeal based on clear evidence of document tampering.
