Ranajit Kumar Meher vs State of Orissa & Ors

Bench: 2 — Kurian

In Brief

The petitioner, lacking prescribed qualifications under the Orissa Non-Gazetted Veterinary Technical Services (Recruitment & Conditions of Service) Rules, 1983 (as amended 1997), sought appointment claiming he met the qualifications advertised in 2004. The Court held that qualifications for appointment must be assessed against the recruitment Rules, not the advertisement. Since the appellant admittedly lacked the Rule-prescribed qualifications, the appeal was dismissed, establishing that no appointment can violate statutory recruitment rules.
