In Brief
Smt. Randhir Kaur's legal heirs challenged an unauthorized exchange of land the donor had gifted to Doaba Public School in 1981. The School's Principal and the Society's President exchanged the valuable gifted property for inferior land without authorization from the governing body. The School became a lessee of its own property. The Supreme Court held that the exchange was wholly illegal and collusive, lacking proper authorization. The court upheld the Trial Court's alternate relief, declaring the gift valid, the exchange void, and restoring ownership to the School. The respondents were directed to pay costs.
