Supreme Court of India 2020-09-03 dismissed

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Three individuals (Rashid Khan Pathan, Vijay Kurle, and Nilesh Ojha) were convicted of contempt for making scurrilous allegations against Supreme Court judges. After their sentencing on 04.05.2020, Pathan filed an application seeking recall of the order dismissing his earlier recall applications. The Registry rejected it as non-maintainable. The Court upheld this rejection, holding that recall applications cannot be used to circumvent the statutory review procedure. The Court dismissed the appeal with exemplary costs of Rs. 25,000, warning that further frivolous filings would invite criminal contempt proceedings or orders restricting future applications.
